If your extension involves work on or near a shared wall, or excavating within 3–6 metres of a neighbouring property, you are likely required to serve Party Wall Notices under the Party Wall etc. Act 1996. If the adjoining owner does not consent, a Party Wall Award will need to be agreed.
A Party Wall Award is a legally binding document prepared by one or more surveyors that sets out the rights and responsibilities of the building and adjoining owners. It includes details of the planned work, timelines, and any protective measures to safeguard neighbouring property.
The process duration depends on the nature of the works and whether the adjoining owners consent. If they do, it may take just a few weeks. If not, and a Party Wall Award is required, the process can take 4–8 weeks depending on complexity and cooperation between parties.
In most cases, the Building Owner (the person doing the work) is responsible for covering the cost of the surveyor(s). This includes the cost of preparing the Party Wall Award and any related inspections or documentation.
If the adjoining owner does not respond within 14 days, the law assumes they dissent, and a dispute is deemed to have arisen. A Party Wall Surveyor will then need to be appointed to proceed with a formal Award.
If your neighbour provides written consent to the Party Wall Notice within 14 days, you may not need a Party Wall Award. However, it’s still advisable to prepare a Schedule of Condition to document the neighbour’s property before works begin.
