What is a Party Wall Notice?
A Party Wall Notice is a formal written notice served under the Party Wall etc. Act 1996. It’s prepared by the building owner (or their representative) when proposed works may affect a shared wall/structure, a boundary, or nearby foundations. The notice gives the adjoining owner clear information about the works and the legal right to respond in writing.
The 3 main types of Party Wall Notice
- Line of Junction Notice (new wall built at or astride the boundary line)
- Party Structure Notice (works to a party wall, party floor/ceiling, or party fence wall)
- Notice of Adjacent Excavation (excavations within 3m or 6m, depending on depth)
Some projects require more than one notice type (for example, an extension involving both boundary works and excavations). To avoid delays, it’s important that all relevant notices are served correctly on every adjoining owner.
If you need to confirm the adjoining owner’s details, you can search via the Land Registry.
When should a Party Wall Notice be served?
Notices should be served as early as practical so the minimum notice period can run and there is time to deal with queries. Notices are generally valid for 12 months, so on longer projects be mindful that a notice can expire if works don’t start in time.
Minimum notice periods before works start
- Party Structure Notice: at least 2 months before works commence
- Line of Junction Notice: at least 1 month before works commence
- Notice of Adjacent Excavation: at least 1 month before works commence
