What is a party wall notice?
Party Wall Notices are legal documents prepared by a building owner or representatives regarding building work intended to be conducted close to a neighbouring property or boundary line.
Party Wall Notices are intended to inform adjacent property owners of the plans for the intended works that may affect their property / boundary. There are 3 types of notice:
- Line of junction
- Party structure
- Three metre / six metre notice (adjacent excavation)
For some plans and proposals, it is necessary to issue more than one type of notice. It is essential that all notices required under the Act are issued.
If you are a building owner and need to obtain the adjacent property owners details you can search for them via the Land Registry.
When should a party wall notice be served?
Party Wall Notices should be served as soon as possible to ensure there is sufficient time for the notice to run and for any related negotiations in the event a dispute arises.
Notices are however only valid for 12months so care should be taken to ensure notices do not expire before planned work commences, which can sometimes be a factor to consider on larger projects.
Party Structure Notices are Required to be served 2 calendar months prior to the commencement of works and Line of Junction and Notice of Adjacent Excavation 1 calendar month prior to the commencement of works.
